Our team will look after you and your family with advice on trusts, enduring powers of attorney, wills and estate planning. Having your affairs in order will make life easier for your loved ones in the event something happens to you.
Once you’ve made a will, it needs regular reviews to include changes like the birth of a child or the start or end of a relationship - when last did you update yours?
Many New Zealanders don't have a current will, this means that on their death their property is distributed according to law and not necessarily as families or the deceased would have wished. In your will you name heirs, executors, and guardians for any minor children. Where trusts and business succession issues are involved, wills can be very complex but our team is here to guide you through the process.
What is an Enduring Power of Attorney?
An enduring power of attorney allows you to choose who will make decisions and sign on your behalf if you are physically or mentally incapacitated. There are two types; the first is for personal care and welfare, which authorises the delegated person to make decisions about things like your medical treatment. The second type covers property, allowing your nominated attorney to sign documentation and make decisions about your assets and physical property, including bank accounts. Without an enduring power of attorney, should anything happen to you, your family will have to apply to court to have one appointed, causing delay, stress and worry during a difficult time.
Why consider setting up a trust?
Forming a trust is a way of protecting assets and accumulating wealth for future generations. A trust is set up for many reasons including:
Estate planning to provide for, and benefit, future generations;
Protection against relationship property and third party claims;
Retirement planning; and
Charitable purposes
